1. Agreement to Terms
By accessing and using the Cockroach Janta Party platform ("Platform," "we," "us," "our," or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.
These Terms are governed by the laws of the Republic of India, and you agree to submit to the jurisdiction of Indian courts. This agreement is made under the Indian Contract Act, 1872.
2. Our Mission & Commitment to Non-Discrimination
The Cockroach Janta Party is a platform dedicated to:
- Publishing fact-based articles on governance, policy, and public accountability
- Aggregating citizen complaints and grievances through transparent mechanisms
- Creating performance report cards for government institutions based on verifiable data
- Promoting informed public discourse on policy matters
- Advocating for constitutional rights and good governance
2.1 Explicit Non-Targeting Policy
We categorically state and commit that:
- We do NOT target or discriminate based on caste, religion, gender, sexual orientation, region, or political ideology
- We do NOT publish content designed to incite violence, communal discord, or hatred against any group
- We do NOT publish unverified rumors, conspiracy theories, or misinformation
- All content is rooted in verifiable data, public records, and evidence
- Our editorial standards prioritize factuality and accountability over sensationalism
2.2 Data-Driven Journalism
Every article, report card, and complaint analysis on our platform is backed by:
- Official government data and public records
- Citizen-reported information and grievances

- Transparent attribution and source documentation

3. User Rights & Responsibilities
3.1 Your Rights as a User
As per Article 19 of the Indian Constitution, you have the right to:

- Create Content: Write and publish articles on matters of public concern

3.2 Your Responsibilities
You agree to:

- Respect Privacy: Not post personal information (phone numbers, addresses) without consent
- No Hate Speech: Not publish content that incites violence, hatred, or discrimination
- No Defamation: Not post false, malicious statements designed to damage reputation
- Respect Copyright: Not plagiarize or infringe on intellectual property rights
- No Spam: Not engage in commercial promotion or unsolicited advertising
- Constitutional Limits: Exercise your rights within limits prescribed by Article 19(2) (national security, public order, morality)
4. Content Policy & Moderation
4.1 What We Publish

- Report Cards: Aggregated performance metrics for ministries, departments, and officials
- Public Opinion: Aggregated citizen sentiment on policy matters

4.2 What We Don't Publish
- Unverified rumors or conspiracy theories
- Personal attacks or defamatory content
- Hate speech targeting caste, religion, gender, or other protected characteristics
- Incitement to violence or illegal activity
- Doxxing or non-consensual sharing of private information
- Commercial spam or misleading advertising
- Content violating Indian law or constitutional limits
4.3 Moderation Process
We maintain a transparent moderation policy:
- Trained moderators review content before publication
- Users are notified if content is rejected with clear reasons
- Users can appeal moderation decisions within 7 days
- We publish transparency reports on moderation actions quarterly
5. Complaint Aggregation & Report Cards
5.1 How Complaints Are Handled

- You retain the right to remain anonymous or claim attribution for your complaint
- We do not share your personal information without explicit consent

Report cards are strictly data-driven and not politically motivated. We welcome corrections or responses from government institutions.
6. Constitutional Rights & Fundamental Duties
6.1 Fundamental Rights Affirmed
This Platform affirms the following Fundamental Rights from the Indian Constitution:
- Article 14 (Equality Before Law): We treat all users equally regardless of caste, religion, or background.
- Article 19 (Freedom of Speech & Expression): We protect user speech within constitutional limits.
- Article 21 (Right to Privacy & Life): We secure user data and respect privacy.
- Article 25-28 (Freedom of Religion): We do not discriminate based on religion.
- Article 29 (Rights of Minorities): We protect minority voices and perspectives.
6.2 Fundamental Duties
This Platform promotes the Fundamental Duties outlined in Article 51A:

- Cherish and follow the ideals of the Indian freedom struggle
- Uphold the sovereignty, unity, and integrity of India
- Defend the nation and render national service
- Promote harmony and brotherhood among all citizens
- Value and preserve our composite culture
7. "As-Is" Service Disclaimer & Content Accuracy
The Cockroach Janta Party platform and all content are provided on an "as-is" and "as-available" basis without any warranties or guarantees of any kind, whether express or implied. Specifically:
- We do not guarantee that the platform will be error-free or continuously available
- We do not guarantee that all information provided is 100% accurate, complete, or timely
- We do not guarantee that content is suitable for any particular purpose or outcome
- We do not guarantee that the platform is free from viruses, malware, or other harmful code
- We disclaim any warranties of fitness for a particular purpose, merchantability, or non-infringement
All information on this platform is provided for informational purposes only and does not constitute professional, legal, financial, medical, or political advice. Users rely on all platform content and third-party information entirely at their own risk. We urge users to independently verify critical information through official government sources, courts, and reliable journalistic outlets before relying on it for important decisions.
8. Limitation of Liability
To the maximum extent permitted by Indian law, the Cockroach Janta Party, its owners, team members, volunteers, and operators shall not be liable to you for:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business opportunity, or goodwill
- Loss or corruption of data, information, or access
- Damages arising from use, inability to use, or interruption of the platform or its services
- Damages resulting from unauthorized access, data breaches, or security incidents beyond our reasonable control
- Any damages whatsoever arising from inaccurate, incomplete, or misleading content
- Damages from reliance on third-party links, external websites, or information sources
The platform's aggregate liability to any user shall not exceed ₹0 (zero rupees).
Your sole and exclusive remedy for any problems, dissatisfaction, or complaint with the platform is to stop using our services. You may not pursue legal action, claim damages, seek compensation, or pursue restitution for any reason related to the platform. This limitation applies even if we have been advised of the possibility of such damages.
9. User Indemnification
By using the platform and submitting any content, you agree to indemnify, defend, and hold harmless the Cockroach Janta Party, its owners, team members, volunteers, employees, and agents from and against any and all:
- Claims, damages, liabilities, and legal expenses (including reasonable attorneys' fees) arising from your use of the platform
- Claims arising from your submitted content, articles, complaints, or comments
- Claims of defamation, copyright infringement, or intellectual property violations related to your content
- Violations of these Terms, applicable law, or the rights of third parties
- Any false, inaccurate, or misleading information you provide to the platform
This indemnification obligation survives termination of your account and use of the platform.
10. Third-Party Links & External Content
The platform may contain links to external websites and third-party content. We are not responsible for:
- The accuracy, completeness, or reliability of external websites or their content
- Privacy practices, security, or data handling by third-party sites
- Any damages or losses arising from your access to or use of external websites
- Availability or uptime of external links or referenced services

11. Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms, or any delay or failure in providing the platform or services, if caused by circumstances beyond our reasonable control, including but not limited to:
- Internet outages, infrastructure failures, or connectivity issues
- Natural disasters, acts of God, or extreme weather events
- Government directives, regulatory actions, or legal constraints
- Cyberattacks, distributed denial of service (DDoS) attacks, or hacking attempts
- Pandemics, epidemics, or other public health emergencies
- War, terrorism, civil unrest, or other force majeure events
12. No Professional Advice
The content on this platform, including articles, analyses, complaints, and report cards, is not intended to and does not constitute:
- Legal advice or legal opinion
- Medical or health advice
- Financial or investment advice
- Tax or accounting guidance
- Professional counseling of any kind
If you require professional advice on any matter, you should consult with a qualified professional (lawyer, doctor, financial advisor, accountant, etc.) before taking any action based on platform content.
13. AI-Assisted Content & Hallucinations Disclaimer
The Cockroach Janta Party platform and its infrastructure is built using Claude Code and powered by Anthropic's Claude Opus AI model. While the platform is developed, maintained, and overseen by human operators and developers, certain aspects of content generation, moderation assistance, and platform functionality may involve AI assistance.
13.1 AI Hallucinations & Limitations
Large Language Models (LLMs) like Claude are known to occasionally "hallucinate"—generating plausible-sounding but false, inaccurate, or misleading information. While the platform implements human review and fact-checking processes, AI-assisted tools may occasionally:
- Generate inaccurate information despite best efforts to verify
- Produce misleading statements that appear authoritative
- Provide outdated information presented as current fact
- Make logical errors or draw incorrect conclusions
- Misinterpret complex data or government records
13.2 Liability for AI-Generated or AI-Assisted Content
To the maximum extent permitted by Indian law, the Cockroach Janta Party, its owners, developers, and operators shall NOT be liable for any inaccurate, incorrect, misleading, or hallucinated information that results from AI-assisted content generation, moderation, or platform functionality.
Specifically:
- Any incorrect information resulting from AI hallucinations is NOT a deliberate mistake or negligence by the platform owner or team
- The platform owner cannot be held liable for AI model limitations or errors inherent to language model technology
- Users acknowledge they are consuming content that may involve AI assistance and accept the associated risks
- No damages, claims, or legal action shall be pursued against the platform or its operators for AI-related inaccuracies
13.3 Human Review & Best Efforts
While AI hallucinations cannot be completely eliminated, the Cockroach Janta Party implements human review, fact-checking against official sources, and editorial oversight to minimize inaccuracies. However, the presence of these safeguards does not guarantee 100% accuracy or eliminate the possibility of AI-generated errors. Users should independently verify critical information through official government sources before relying on platform content for important decisions.
14. Governing Law & Dispute Resolution
These Terms and all disputes arising out of or relating to the platform are governed by the laws of the Republic of India, without regard to conflict of laws principles. Any disputes shall be resolved as follows:
- Good-Faith Negotiation: Parties shall first attempt to resolve disputes through good-faith negotiation and discussion
- Arbitration: If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996
- Arbitration Details: The arbitration shall be administered under the Indian Arbitration Act; the seat of arbitration shall be New Delhi, India; the language of arbitration shall be English; and a single arbitrator shall be appointed unless the claim exceeds ₹1,00,00,000 (One Crore), in which case a three-member arbitral tribunal shall be constituted
- Jurisdiction: The courts of India shall have exclusive jurisdiction over any legal proceedings, and you irrevocably consent to the jurisdiction of Indian courts
You acknowledge that by accepting these Terms, you are waiving your right to pursue disputes in court and agree to submit exclusively to arbitration under Indian law.

16. Intellectual Property Rights
Content published on the Platform:
- Platform Content: Articles, report cards, and analysis are © Cockroach Janta Party. You may share with attribution.
- User Content: You retain rights to content you submit. By publishing, you grant us a license to reproduce and share.
- Complaints & Grievances: You consent to anonymized aggregation for report cards and public analysis.
- Fair Use: Educational and journalistic use of our content is permitted with attribution.
17. Free Platform & User-Generated Content Liability
10.1 Free Platform for All Users
The Cockroach Janta Party platform is completely free for any user to post content, articles, complaints, demands, and reports. There are no paywalls, subscriptions, or access fees. All features are available to registered users without charge.
10.2 Content Moderation & Accuracy Efforts
The Cockroach Janta Party makes significant, continuous efforts to ensure accuracy and prevent misleading or incorrect information on our platform:
- All user-submitted content is reviewed by trained moderators before publication
- We verify factual claims against public records and reliable sources
- We require citations and evidence for all allegations and complaints
- We fact-check articles and report cards using multiple data sources
- We remove or flag content that violates our accuracy standards
- We maintain a transparent editorial process and can justify content decisions
- We publish corrections and clarifications promptly when errors are identified
- We conduct regular audits to identify and address inaccuracies
10.3 Limitation of Liability for User-Generated Content
Despite our best efforts and robust moderation processes, some inaccuracies, inconsistencies, or misleading information may occasionally be published on the platform. In such cases:
- The Cockroach Janta Party platform, its owners, operators, moderators, and employees shall NOT be held liable for any damages, losses, or claims arising from inaccurate, misleading, or incorrect user-generated content published on the platform.
- Users acknowledge that they consume content at their own discretion and are responsible for independently verifying information before taking any action based on it.
- The platform provides tools for users to report inaccuracies, which we will investigate and address in good faith. However, we do not guarantee removal or correction of all flagged content.
- This limitation applies to all types of user-generated content, including but not limited to: articles, complaints, demands, report cards, comments, and aggregated analyses.
- Users who publish content are solely responsible for the accuracy and lawfulness of their submissions. They agree to indemnify and hold harmless the platform from any claims related to their content.
10.4 Content Accuracy Disclaimer
The Platform is provided "as is" for the aggregation and publication of citizen voices, complaints, and analysis. While we strive for accuracy, the platform does not guarantee that:
- All published content is 100% accurate, complete, or up-to-date
- Information will remain accurate over time as facts and circumstances change
- All sources cited are authoritative or current
- User-submitted data has been independently verified by external sources
- Aggregated statistics or report cards are free from computational errors
Users should treat all platform content as one perspective among many, and independently verify critical information through official government sources, courts, and reliable journalistic outlets before relying on it for important decisions.
18. Termination of Account
We may suspend or terminate your account if you:
- Violate these Terms or applicable law
- Engage in harassment, spam, or illegal activity
- Submit false or fraudulent information
You may also delete your account at any time. Termination does not affect published content, which may be retained for historical accuracy.
19. Changes to These Terms
We may revise these Terms at any time. Changes will be effective upon publication. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via email.
20. Severability & Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect. These Terms, along with our Privacy Policy, constitute the entire agreement between you and the Platform.
21. Legal Compliance & IT Act Safe Harbour
This agreement complies with:

21.1 Safe Harbour under IT Act 2000, Section 79
The Cockroach Janta Party acts as an intermediary as defined under Section 2(w) of the Information Technology Act, 2000. In accordance with Section 79 of the IT Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, the platform:
- Does not host, generate, or publish unlawful content intentionally
- Acts in good faith to disable access to content upon notification of unlawful activity
- Acts in good faith to remove content that violates applicable law or these Terms
- Maintains a transparent grievance redressal mechanism for users
- Preserves evidence and complies with legal requests and court orders
As an intermediary, the platform shall not be liable for any third-party information, data, or communication made available on the platform, provided the platform acts in good faith and complies with applicable law.
